The Supreme Court on Thursday ordered the removal of encroachments on railway land in 15 days and to restore the Karachi Circular Railway within a month.

سپریم کورٹ کراچی رجسٹری میں سرکلر و لوکل ریلوے اور کراچی ماسٹر پلان کی بحالی اور تجاوزات کے خاتمے سے متعلق کیسز کی سماعت ہوئی اور جسٹس گلزار احمد کی سربراہی میں تجاوزات کے خاتمے سے متعلق اجلاس ہوا، اس دوران سپریم کورٹ نے کراچی میں ریلوے کی زمین سے تجاوزات 15 دن میں ہٹانے اور سرکلر ریلوے ایک ماہ میں چلانے کا ٹاسک وزیراعلیٰ سندھ کو سونپ دیا
سپریم کورٹ کی جانب سے گذشتہ ایک سال سے پاکستان ریلوے و سندھ حکومت کو کراچی سرکلر ریلوے کی بحالی اور تجاوزات کے خاتمے کے لیے احکام جاری کیے جارہے ہیں تاہم متعلقہ اداروں نے نہ تو تجاوزات کے خاتمے کے لیے کوئی اقدامات اٹھائے ہیں اور نہ ہی سرکلر ریلوے کی بحالی کے لیے کوئی منصوبہ بندی کی ہے،وزیر مینشن تاملیر ہالٹ اور لیاقت آباد سے سائٹ تک پھیلے 43کلو میٹر ریلوے ٹریک کے دونوں اطراف قائم کچی آبادیاں اور ہزاروں پختہ مکانات و کثیر منزلہ عمارتیں تجاوزات کی شکل میں موجود ہیں
سپریم کورٹ کے گذشتہ حکم کی بجاآوری کے لیے دسمبر 2018 میں سرکلر ریلوے ٹریک کو دونوں اطراف سے تجاوزات سے پاک کرنے کی مہم کا آغاز کیا گیا جس میں کراچی میونسپل کارپوریشن اور ڈسٹرکٹ میونسپل کارپوریشن نے ٹریک پر قائم کمرشل تجاوزات ہٹانے میں پاکستان ریلوے کی مدد کی تاہم ٹریک پر قائم مکانات اور آبادی کی وجہ سے تجاوزات کے خاتمے کی مہم مکمل نہ ہوسکی او ر اب بھی ٹریک کا ایک بڑا حصہ تجاوزات کا شکار ہے۔
The Supreme Court on Thursday ordered the removal of encroachments on railway land in 15 days and to restore the Karachi Circular Railway within a month.
During a hearing at Supreme Court’s Karachi registry, the railways secretary told the court than 10 acres of land has been taken back from squatters.
Justice Gulzar Ahmed then directed the secretary railways to remove encroachments from the railway land within a period of two weeks. “In a month’s time the Karachi Circular Railways should be restored,” the judge remarked.
The bench directed the Sindh chief secretary to launch an anti-encroachment operation with the help of the Karachi mayor and other relevant officials to clear the railway lands of encroachments.
Meanwhile, the bench directed the Centre, provincial government and the city administration to make provisions for alternative land to be allotted to those displaced by the anti-encroachment drive.
Perhaps the biggest hurdle in the revival of the KCR was the displacement of settlements along its track. The city administration has been reluctant to demolish the houses since the Sindh government has not prepared a resettlement plan for these residents. The city administration is fearful of public retaliation if residential encroachments are demolished.
Last year, the Supreme Court had directed the authorities to immediately revive the Karachi Circular Railway. The top court directed the civic authorities to clear all railway tracks across the city of encroachments.
Since the SC’s November order for the revival of the KCR, the Pakistan Railways, aided by law enforcement authorities and the city administration, made several attempts to evict the residents. Each time, however, they received push-back in the absence of an alternative settlement plan.
The KCR track stretches along 43.2 kilometres, which includes the main line of Pakistan Railway and KCR track with 24 stations.
During the proceedings, Justice Ahmed directed the provincial government to look into the possibility of reviving the tram service in the city. He suggested that Pakistani engineers, working abroad, may be consulted to revive the service.
