The Supreme Court accepted Malik Riaz’s offer to pay Rs460 billion within a period of seven years for Bahria Town Karachi.
The apex court restrained the National Accountability Bureau (NAB) from proceeding with its reference against the real estate developer and relevant officials. The company will have to deposit the amount to the top court within seven years.
Bahria Town made this offer for the land it had acquired in exchange from the Malir Development Authority (MDA) on the outskirts of Karachi.
Upon payment of the complete amount, the ownership of the land would be transferred to Bahria Town after which it would gave the same to its dwellers on 99-year lease, ruled the court.
The firm is required to deposit Rs25 billion until 27 August with the first installment of Rs2.5 billion to be paid in Sept, followed by an equal amount to be paid every month for next four years.
The rest of the amount would be paid within three years, the top court said, adding upon delay in payment of installments, the company will have to pay interest up to four per cent.
The SC on May 4, 2018 had declared the MDA’s exchange of land with Bahria Town null and void and directed NAB to probe into the transfer of the land. The court also barred the real estate firm from selling any plot or constructed apartment in the housing scheme until further orders.
The apex court had clarified that it would recognise only the site plan of Bahria Town, Malir, identifying 16,896 acres in the district that had been signed both by the developer and the Space and Upper Atmosphere Research Commission.
It had also told the counsel that while putting forward an offer, he should bear in mind that the court was “not sitting on a negotiating table”.

بحریہ ٹاؤن نے چار سوساٹھ ارب سات سال میں ادا کرنے ہیں، مکمل ادائیگی کے بعد زمین بحریہ ٹائون کے نام منتقل ہوگی اور بحریہ ٹاؤن رہائشیوں کو ننانوے سال کی لیز دے گا۔
جسٹس شیخ عظمت سعید پر مشتمل تین رکنی بینچ نے بحریہ ٹاؤن عملدرآمد کیس کی سماعت کے دوران بحریہ ٹاؤن کراچی کی پیشکش قبول کرلی جس کے تحت بحریہ ٹاؤن انتظامیہ کو 7 سال میں 460 ارب روپے کی ادائیگی کرنا ہوگی۔
سپریم کورٹ نے کہا کہ بحریہ ٹاؤن 27 اگست تک 25 ارب کی ڈاؤن پیمنٹ کرے گا- اس کے بعد پہلی قسط ڈھائی ارب روپے کی یکم ستمبرکو دے گی پھر بحریہ ٹاون ساڑھے چار سال ڈھائی ارب روپے ماہانہ دے گا جبکہ باقی رقم کی مکمل ادائیگی تین سال میں ادا کی جائےگی ۔
سپریم کورٹ نے قرار دیا کہ بحریہ ٹاؤن اگر اقساط کی ادائیگی میں تاخیر کرے گا تو اسے 4 فیصد سود ادا کرنا ہوگا، رقم عدالت میں جمع ہوگی پھر اس کو قانون کے مطابق جس کو دینی ہے دیں گے۔
سپریم کورٹ نے کیس کے متعلقہ لوگوں کے خلاف قومی احتساب بیورو (نیب) کو ریفرنس دائر کرنے سے بھی روک دیا اور کہا کہ اگر بحریہ ٹاؤن والے ڈیفالٹر ہوئے تو ریفرنس دائر کیا جائے گا۔
یاد رہے کہ 4 مئی 2018 کو سپریم کورٹ نے بحریہ ٹاؤن کو سرکاری زمین کی الاٹمنٹ اور تبادلے کو غیر قانونی قرار دیتے ہوئے بحریہ ٹاؤن کراچی کو رہائشی، کمرشل پلاٹوں اور عمارتوں کی فروخت سے روک دیا تھا۔
جسٹس اعجاز افضل کی سربراہی میں تین رکنی بینچ نے 1-2 کی اکثریت سے بحریہ ٹاؤن اراضی سے متعلق کیسز پر فیصلہ سناتے ہوئے اس معاملے کو قومی احتساب بیورو (نیب) کو بھیجنے اور 3 ماہ میں تحقیقات مکمل کر کے ذمہ داران کے خلاف ریفرنسز دائر کرنے کا حکم دیا تھا۔
عدالتی فیصلے میں کہا گیا تھا کہ بحریہ ٹاؤن کو اراضی کا تبادلہ خلاف قانون تھا، لہٰذا حکومت کی اراضی حکومت کو واپس کی جائے جبکہ بحریہ ٹاؤن کی اراضی بحریہ ٹاؤن کو واپس دی جائے۔ بعد ازاں عدالت کی جانب سے بحریہ ٹاؤن کراچی کیس میں دیے گئے فیصلے پر عمدرآمد کےلیے ایک خصوصی بینچ تشکیل دیا گیا تھا۔
